Terms of Service

These Terms ("Terms") are a legal agreement between you ("you", "Customer") and REQARCHITECT LTD, a company registered in the United Kingdom, operating the platform Archiet at archiet.com ("Archiet", "we", "our", "us"). By creating an account or using the service you agree to these Terms.

1. The service

Archiet is a software platform that takes a Product Requirements Document (PRD), an Architectural Genome, or a marketplace template as input and generates a downloadable ZIP archive of working application source code in your chosen technology stack. Stacks marked "preview" (currently Salesforce Apex, SAP CAP, Dynamics 365) ship with a clearly visible PREVIEW banner and are provided as-is.

2. Eligibility & account

• You must be at least 16 years old and able to enter binding contracts.
• You are responsible for keeping your password and API keys confidential. We use httpOnly cookies for session tokens to reduce XSS exposure but cannot prevent password sharing.
• One person, one account. Workspaces may have multiple members; that is allowed.

3. Plans & payment

• Free plan: limited monthly generations, no commercial use restriction on the output (you own the code you generate).
• Paid plans: monthly or annual billing via Stripe, Flutterwave, or Paystack. Prices on /pricing; we will give 30 days' notice before any price increase to existing customers.
• Marketplace templates: one-time purchase for a license to use the generated code in your own product.
• Refunds: see our Refund Policy.
• All amounts are in USD unless stated otherwise. You are responsible for any local taxes.

4. Ownership of generated code

You own the code Archiet generates for you. We claim no copyright, royalty, or licence over the output. You may ship it commercially, modify it, open-source it, or relicense it, subject to:

• The licences of any third-party libraries the generated code depends on (we surface these in the ZIP's README).
• Free-tier outputs include a small "Built with Archiet" footer badge by default. You can remove the badge by upgrading to any paid plan or by deleting the relevant component yourself — we do not enforce attribution.

5. Your content

• You retain all rights to the PRDs, genomes, and content you upload.
• You grant us a non-exclusive licence to process your content for the sole purpose of generating code for you and improving the service.
• We do not sell or share your uploaded content with third parties beyond the sub-processors listed in our Privacy Policy.

6. Acceptable use

You agree not to use Archiet to:

• Generate malware, surveillance tooling, deceptive impersonation systems, or anything that would breach applicable law.
• Probe, scrape, or attempt to disrupt the service or any other customer's data.
• Resell the Archiet platform itself (you may resell software you build using Archiet's generated code — that's allowed).
• Bypass rate limits or use multiple accounts to evade plan caps.

Violation may result in account suspension, with notice where practical. Serious violations (illegal content, security attacks) may result in immediate termination.

7. Service availability

We target 99.5% uptime for the platform but make no guarantee. Codegen is best-effort: some PRDs may produce lower-quality output than others, and stacks in preview tier are unstable by definition. We log uptime publicly at /status.

8. Disclaimers & liability

Archiet is provided "AS IS" without warranty of merchantability, fitness for a particular purpose, or non-infringement. The generated code may contain bugs, security defects, or compliance gaps. You are responsible for reviewing it before deploying to production.

To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability; in those jurisdictions, the above limitations apply to the maximum extent permitted.

9. Indemnity

You agree to indemnify and hold us harmless against third-party claims arising from your use of the generated code, including claims that your final shipped product infringes copyright, patents, or trade secrets.

10. Termination

• You may terminate by deleting your account in settings at any time. Paid plans run until the end of the current billing period.
• We may terminate or suspend for breach of Section 6, non-payment, or if we are legally required to.
• On termination, we delete your data per the retention schedule in our Privacy Policy.

11. Changes to these Terms

We will notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute will be resolved exclusively in the courts of England and Wales, except where consumer protection law in your jurisdiction requires otherwise.
